The trial to determine who is at fault for the accident I was in in 2000 is OVER!! WOW, the judicial system, as unfortunate as it would like itself to appear, had to put up with the costly burden of attending to the rights of an ordinary citizen. Okay, so I know little of how things work in the Mad Hatter’s Tea Party and the land of Court, but against the odds, I persevered! What, I didn’t simply lay like good citizen dog while my rights were trampled? Are not the tax dollars of ordinary citizens available within the judiciary to ensure that a balance exits in this country between the haves and have-nots when it comes to justice? It’s as plain as the nose on my face (and it’s a French one), that the wealthy have an advantage over those who are not because they can afford the high paid lawyers to work around the clock to manipulate the system. So, c’mon, tell me, who would dare stand up for their rights against one of the largest Insurer in Canada… WHO and WHY?! —MO

Let’s see this was a civil trial because of a traffic accident. Well usually it’s the lawyers for the respective insurance firms that fight it out, so there’s no money out of your pocket so what are you bitching about.

BT: you’re obviously not very familiar with the area of personal injury law. Often, it’s the individual fighting against the insurance company for a settlement. Of course that *is* after fault is determined, but it’s usually the former that’s the biggest fight because large insurance companies have resources the average joe doesn’t 🙁
And as far as accidents and injuries, no amount of money REALLY makes up for having a serious injury — often one that leaves lifelong effects 🙁

PK, but the OB is talking about the trial to DETERMINE fault, which is the responsibility of the insurance company, even though the driver is sued. The way it goes is that there is a traffic accident. The respective companies try to dertmine fault. If there is not an agreement, then the drivers can sue each other and the Originating Notice and Statement of Claim is served on the driver. When the driver receives this, they give it to the insurance company and the insurance company’s lawyers do the representing until fault is determined and award, if any is issued. Now a driver always has the right to engage their own lawyer but it is on their dime.

I know, BT, your comment just read like it’s always the insurance companies that fight it out. My point is, in most cases it’s the little guy against the insurance company, not this case.
Though, if it’s a promising case, a contingency fee can always be arranged.
