The court system and a few choice lawyers in this town make it very hard for the innocent and victims to be protected and given justice.
First of all police. On most of the curfews people are never checked up on EVER and secondly the law, when someone strangles you leaving you grasping for air you going to put them on probation but when someone strangles you and kills you this is grounds for imprisonment how is the attempted murder and actual murder so far from proper incarceration ? Not only that you drag the cases on for over a year with having the victims go to court and then make them retell everything that the person did. Whilst no judge is demanding a lawyer to refrain from further questioning and wrongful assumption—building questions whilst the victim is only allowed to answer and not able to give a rebuttle to the assumption—building questions pointed at them and yet the over worked, not so caring crown employees rely on few facts and are barely ever organized with the cases or the facts. How can justice be upheld? With this gruelling process it’s no wonder countless women never report their injustices towards them as the system is fucked, flawed and outdated. Victims dont feel safe in reporting, and really what’s the point in reporting anything if it happens so much and you are treated so poorly. When most of these people break their restraining orders and are easily able to leave their house despite on a curfew because the police never follow up, why would a person ever want to report things when your information is not private and is shared around with victim services, new start counselling and other programs that call and call the victims, I know this is supposed to help those that can’t pay for legal advice and counselling but please NOVA SCOTIA COURT don’t send my information and telephone numbers around to these people or letters to my address you think I need everyone in my building knowing I’m a victim of domestic violence? No be private, be more accountable with dealings over curfew and probation and house arrest people as these people slip through the wide cracks in the police system and are not punished hard enough for their actions. I will never report another domestic to the police or anybody it’s pretty clear the reception one gets in the court room. That is a very serious charge and requires evidence to support it. You do understand the legal system, don’t you? The accused is innocent until proven guilty. Do you see the word “proven”? Do you know what it means? It means bringing conclusive evidence in support of his guilt. Unfortunately, your bitch is just a series of empty unsupported assertions which any minimally competent lawyer for the defence would have little trouble in demolishing.

The reason why they make you wait a year isn’t because they want to be assholes, it’s because the courts are backed up and it takes time to get your hearing. Longer if it goes to trial. They aren’t going to hear your domestic abuse case over someone’s domestic abuse case that happened months before yours.
And the reason why they make you dredge this up is because in order to have a trial, you need witnesses, and part of putting a charge against someone is telling the story of what happened. You know it happened, but the courts do not (and until you DO provide evidence that it did happen, the courts do not think it happened), and a deposition is only one piece of the puzzle — if you didn’t testify in court, then what’s the point of charging someone? A charge can’t be brought to trial without evidence. That’s why a hearing takes place — to see if there’s enough evidence to take it to trial. It’s rough being a victim and having to face the person who hurt you, but if you want justice, that’s what’s gotta happen. It’s not the court’s fault, or any lawyer’s fault (everyone is entitled to a legal defence — even bastards like Russell Williams and Paul Bernardo), it’s just how our justice system works.
As for victim’s services — I’m not sure what type of building you live in and what type of neighbours you have, but I’m pretty certain victim’s services doesn’t go around announcing to all your neighbours who they are and why they’re there. They’re just trying to help and you’re spitting all over it. You talk about how you sought help, etc… and then you bitch about victim’s services? Give your head a shake.
I’m really sorry this happened to you, OB, and I hope things work out, and it sucks, but at some point you have to move towards moving on, because the only person you’re hurting in the end is yourself. If this person who assaulted you did what he did, do you really think he cares how much you’re hurting? That’s the sad reality in this whole thing. And that’s what victim’s services is there for. And I’m also sure that if you didn’t want them to come to your home, you could go see them elsewhere.

The reason you have to wait a year is because the courts are jammed up with marijuana posession/cultivation/dealing and other related charges. Huuuuuge waste of the courts time, taking people to court for a victimless crime. Thanks to Harper’s new agenda it’s going to get worse and worse.
