I don’t think shooting either the dog or the owner with any type of gun, BB, pellet or otherwise, while no doubt tempting, is a very smart move in this instance. I’d put money on the fact that you would most likely be charged with weapons offences and maybe even jail time, lonnnng before the numpty with the dog would get charged for digging up your garden.
