If a product is legally available for sale, a consumer should have the right to visually identify and inspect what it is they are intending to purchase before the sale.
Our government spends vast sums of tax dollars, utilizing every delay in the book in court, to try and bankrupt small business owners in their race for control and to save us all from ourselves.
The judge noted that unlike other consumer products, there is no safe level. Under a regime of “no safe level,” no pharmaceutical drug could exist, as nearly every drug has some dangerous side effects. People wouldn’t drive since driving is far from 100% safe. Parents wouldn’t allow their kids to participate in sports given the very real possibility of injury.
The only appropriate use of “no safe level” would be in this sentence: There is no safe level of the public being exposed to any commentary by government that includes “no safe level.”
Her decision is a slippery slope.

  2. I believe he is talking about Mader’s Tobacco Store in Kentville. And I agree, if beer, wine, and spirits can be in the open and advertised, so should tobacco.

  3. Yes this is about Bob Gee’s case, Maders Tobacco. Also, apparently the Coast won’t let you name judges by name – interesting. You’d think if a judge can make a ridiculous ruling, the public should be allowed to call them out on their bullshit. So not only can we not see tobacco products, we can’t name judges, either…

    Every retailer followed the law or paid the fine when they didn’t. This man has tied up the courts at an unknown cost to taxpayers, was given a very leniant fine (compared to other store’s violations) of $430 and is now told to follow the laws every other person follows. Now hes up to $50,000 worth of legal bills and is unsure of the future financial state of his store………. I must be missing something.

  6. Oh and I forgot, your kids can go into any NSLC store but not a tobacco store. So how many people are killed or injured because of impaired driving? How many people are assaulted by people who have been consuming alcohol? I don’t recall anyone assaulting someone because they had too much to smoke.

  7. Bro Tim, I’m not trying to start an argument with you, but it is illegal for a person under the age of 19 to enter any NSLC retail store. If a child is with their parent, that law still applies. Whether or not the manager/staff enforces the law, its still the law. I know from severel friends experiences the LC’s in the Superstores enforce this law strongly. I have never wanted to bring my offspring into such a place to find out first hand, but they are very credible sources and I doubt they would make that sort of story up.

    You may not recall anyone assaulting another person because of too much to smoke, but I can recall numerous robberies for packs of cigarettes. I can also recall numerous cases of individuals being assaultied and having their smokes and cash stolen. There was recently the man on Bayers and Connaught getting stabbed in the face over a cigarette.

  9. I totally agree PG. In response to a previous post I wanted to point out that it is actually illegal. So any argument based on those grounds would be counter productive and dismissed by any official.

  10. Kirk, it is not illegal for a child to enter NSLC with an adult and hasn’t been for a long time. Further tobacco stores such as Bob’s restrict anyone under-aged to enter. Since they can’t go in, what is the point of covering up product. It may be a law but one that makes absolutely no sense.

  12. Bro Tim you may be correct, and that would mean I may be wrong. I hate that shit. I tried calling NSLC but as a wonderful Monday to Friday operation there was no answer. Agricola directed my question to their head office and Quinpool transferred me to an automated menu. Google at this point has also failed me. I hate that shit as well, a lot. So now I have two first hand accounts which give no actual credible evidence, and they were in the Superstores. First thing Monday morning we will touch base on this topic, on this thread of course. That is, if you actually care enough to.

Does that make any sense? No evidence for that by any chance, is there? – “in their race for control” – what race for control would that be, Dartmouthy? Any evidence of its existence? – and “to save us from ourselves?” – how does the government propose to do that Dartmouthy? No evidence for that either I suppose, just empty bluster like the rest of the bitch.

    Using his impeccable logic, Dartmouthy goes on to yobber about “no safe level” for drugs, for cars, for kids playing and so on, incoherently concluding that there is no safe level for protection from any government commentary using the phrase “no safe level.” It is incoherent because there is no connection between the two assertions. But, in spite of his impeccable logic, Dartmouthy will not see the absence of any connection.

    In his grandstand conclusion, Dartmouthy trumpets his assertion to the effect that the government “has nothing in store but further contempt for intellect, individuals and small businesses.” How did Dartmouthy know this? What evidence has he given? Don’t bother asking.

    However, given Dartmouthy’s obvious level of intelligence, the biggest puzzle is just how he knew that the government had contempt for intellect. Now that’s a real mystery.
