I was actually talking about the legality of minors smoking the other day with my friend’s father who is a police officer – I was interested to know if it’s illegal for a minor to smoke or if the illegal action is actually the selling of the tobacco. I didn’t think to ask if the act of adult just giving tobacco to a minor is illegal but from the above comments and logical though I suppose it would be.

I believe the infraction is cited as, “contributing to the delinquency of a minor”… I think. I don’t think it’s the same as a retailer selling tobacco to underage kids. FYI- Neglect and adultification are considered forms of abuse. This is not actually reportable to the police although they would certainly investigate if possible but the correct place to report something like this would be to the Department of Community Services. If you witness abusive behaviour towards a minor or if abuse is disclosed to you, you are required BY LAW, to report it or YOU can be held legally responsible. Sure, it rarely happens, but imagine a world where parents who abuse their children IN PUBLIC, were actually made accountable instead of people bitching about their behavior on the internet. If you see it and recognize it as wrong you have just made it your responsibility. Speak up people! Keep our kids safe.
