Well, eastvan, while I frequently decry the rise of the Nanny State some laws and rules are actually good ones. For example: seat belts, infant and child car seats, no drinking & driving, etc.
Yes, some of us are older, but we’re not old. As a point of reference, though, when I was a child seat belts in cars were optional in the back (as were passenger side mirrors), babies were held in their parents arms or laid on the back seat, drinking and driving was legal and killing a person under the influence was not an offense (s/he was drunk after all).
True skateboards, inline skates, and bikes are far different from cars, but a trip through the trauma unit and the brain, spinal cord, and bone units of the IWK should convince everyone of the relevance of helmets.

Good judgement and driver skill….something people have none of today kept us safe. Can anyone explain to me why these self-professed “driving schools” can teach you to parallel park a crew cab truck but don’t ever teach people to handle a slide in the winter. They can tell you what you’re supposed to do, but that’s it. A real waste of money, anyone can read the handbook and get just as much training. As long as there’s alcohol and cars, people are going to combine the two. If it’s not that, it’s weed, still an impairment. Restitution should be the order for all people who injure or kill. A lasting reminder that you were an asshole that made that choice.

Personally I do not wear a helmet. But that is my choice, fine or no fine. Head wounds do bleed alot though…but if you crash anywhere there are limits to the amount you can sue for. Great to be a Canadian from Nova Scotia isn’t it?

Dandros– False. There are multiple helmets out there, and there’s a fit for everyone, that argument doesn’t fly. Hey uh, eastvan, I’m far from “old” and I’m young enough to have been in my teens when the helmet law came into effect. It’s not a joke. Nanny Laws exist because the State needs to protect it’s citizens from itself. It’s not like they just institute a law for the fun of it or to get fine dollars. It’s done because somebody out there has had a serious injury and they held the city responsible. So, the law comes into effect, and stupid kids (or their parents I should say) pay fines, because they don’t feel it’ll ever happen to them.
every province has different laws, in ns there is a helmet law but you can also get a fine for riding on the sidewalk and for not having a bell or light but i don’t know if they enforce those

Dandros4Life: the only way to get around the helmet law in NS is if you’re wearing a Turban. It’s written right into the law. You don’t even have to be Sikh. Just wearing a turban.

The turban exception completely undermines the reasoning for the helmet law. All of a sudden, people like the OP can say “Hey. Why should I follow the law if that turban-wearing person doesn’t have to?” …and I would defend that argument to the end, even though I am very much in favour of helmets.
OP, I think you should refuse to pay the fine, and if the cop shows up in court and you do end up having to speak for yourself, you should use that argument. The law is a farce with that exception included.
I’d like to think that would make the judge say “Yeah… That is retarded.”, let you off, and set a legal precedent that lets other no-helmet offenders off until such time as the law is corrected. …but right now the powers that be are too cowardly to do that.

The fine is a just punishment since there is no good reason to not be wearing your helmet when you know full well that you should be wearing your helmet.

The documentary has to be taken with a grain of salt because of Bill Maher’s extremely bias and condescending attitude towards the people he interviewed (which I didn’t really agree with) but the documentary is extremely interesting and does make a few good points, one of the main ones, if i can remember was to QUESTION EVERYTHING. Of course if he wasn’t an asshole to the people he was interviewing the movie probably wouldn’t have gained it’s popularity either, I mean if any opinion is going to make it it has to be an extreme one right..
About 20 years ago some dude published a study showing smokers were a net benefit to the taxpayer because they die earlier and thus receive less CPP and OAS, and get to pay those crazy high smoke taxes. More smokers = more money for the rest of us.

I think anything less then 135 would be laught at more then it is now. with society at a stupid point (can’t think for themselves) it seems that we need stupid laws. I work on a Neurosurgery floor, and I can tell you first hand that the last thing you want is a head injury. Most people think of it as just a cut on the head, but it can change your life and personality drastically. I see young people all the time whose friends can barely stand to visit them anymore because they’re never going to be the same kid as before the accident. And a small accident can have serious effects, you dont’ have to fall off a bridge for these kinds of things to happen.
So spray paint your helmet to say you hate helmets, or whatever, but wear it. Pay your fine and learn your lesson.
I second PAS’s observations. I had a massive concussion when I was nine – unconscious for a long time, didn’t know my own name for days, out of school for two weeks.
The lasting effect has been on my memory. There is no rhyme or reason to what I do and don’t remember at any given time. It is very frustrating for me because people are often saying, “You remember that time, that show, when we…” and I don’t – not even an inkling.
I could go on at great length about the idiosyncrasies of my memory, but suffice to say it is fakked and the damage cannot be undone. My SO tries not to be frustrated – he’s learned to just accept that there’s a 50-50 chance of drawing the memory out through connect the dots for wifey – and has concluded that once age sets in it’s going to be a wild ride, lol.

I think it’s bullshit that you got fined and it’s a bullshit law, it should a persons choice. If you want to be careless enough to not protect yourself incase of an accident, that’s your perogative.
And the no biking on the sidewalk law is bullshit too…I hate biking on the road b/c you have to be more aware of what’s going on and turning is a bitch…and as a driver, bikers on the road are fucking annoying cuz they’re always so slow and in the way. If bikers are going to be on the road, they should have a separate lane on every road for bikers.
Also, skateboarding/biking is less dangerous than skiing or snowboarding and there’s no law saying that ppl who do that have to wear a helmet.
What’s next? Are pedestrians going to need to wear helmets or body armor to protect themselves from a vehicle that happens to veer onto the sidewalk, or just runs a red light.

There are some incorrect assumptions evident in some of these posts. The signs posted are actually irrelevant. Section 170B of the Motor Vehicle Act requires the wearing of a helmet and is the law without the need for any signage. As far as exemptions, including the one about people like me who have huge melon-heads, the Helmet Regulations provide:
5 The following persons are exempt from the requirement of Section 170A or 170B of the Motor Vehicle Act to wear a helmet:
(a) a person who is in possession of, and produces on request to a peace officer, a valid and subsisting certificate issued by the Registrar of Motor Vehicles certifying that the Registrar is satisfied that the wearing of a helmet would interfere with the person’s religious practices;
(b) a person whose head is more than 66 cm in circumference; or
(c) a person who is in possession of, and produces on request to a peace officer, a valid and subsisting certificate issued by the Registrar of Motor Vehicles on the recommendation of a medical practitioner certifying that the person is, for the period stated in the certificate, unable for medical reasons to wear a helmet.
(b) is really funny… (a) is anything but…

the fact is, people that are serious about skateboarding and have been doing it as a major part of their lives for 10-20 years without a helmet, know their limits, are far less likely to hit their head than the average pedestrian walking down the street in the winter.

I just think that skateboarding got lumped into this whole thing without anyone involved actually understanding the nature of skating and actually researching the risks. They could even keep the law if they wanted it’s just the fact that we’re being targeted extremely heavily lately while other more major issues are falling by the way side.

For the people complaining about medical bills resulting from head injuries and using this to justify this law, how many of you have eaten fast food this week? Or maybe you have played a team sport like soccer or baseball? These sports and many more are responsible for far more injuries than skateboarding. I say all people who eat fast food or any unhealthy things should not be covered under medicare if we are to think in terms of the twisted logic demonstrated by many of the people on here. Also, be sure to wear your sunglasses, hat and sunscreen today. The sun is shining and there is plenty of cancer to go around. There is a way to promote safety but legislation is not the way to do it. Parents seem too busy now to parent so they call on the government to do it for them. If they want their children to wear a helmet. Good for them. If not then that is their decision. Same goes for adults who should be able to choose based on the available information whether they wish to wear a helmet or not. There is no real limit to how far “safety” legislation could go if the government decides to dictate your every move or place you in a bubble so they can save a few dollars in medical bills. Sit at the skatepark for an afternoon and you will quickly see police taking a law that the public would believe was made to protect people and using it as a way that only creates mistrust between them and this segment of society.
Be parents, tell your kids to wear helmets if you feel strongly about this issue but DO NOT attempt to have the government parent society as a whole as this will only lead to reduced freedoms in the future or marginalization of one segment of society while allowing “acceptable” but far more dangerous activities like drinking, and team sports to continue to thrive, especially here in Halifax where drinking seems to be the only thing the downtown has been built to accommodate. If police are to do anything it should be stopping robbers, murderers and rapists. But no, our greatest concern is skateboarders not wearing helmets. Police should not be raising your children because you are too busy working or doing whatever it is that makes you unable to take responsibility for your own safety without constantly worrying about what other people may be doing. Ban alcohol, smoking. fatty and unhealthy food, fast cars, sun tanning, poisonous chemicals, and every other thing that is more dangerous than rolling around on a skateboard, then come give me a ticket for not wearing a helmet. But not before you ticket professional figure skaters, soccer players, rugby players, and all the many other activities associated with a higher potential for head injuries. Until that time I’ll keep right on doing what I’m doing. Everybody does some activity that puts them at risk of death or head injury or any injury. If laws covered all these things there would be very little to eat drink or do since almost anything could be considered dangerous at some level.

Maybe nothing. Unless it’s a standard fine it might appear on the back of the ticket or whatever. If he should have filled something out, but didn’t, you are probably off the hook.

Instead of the government control scenario you paint, though, there is also the possibility of private health care. Every risk you take could be measured by health insurance companies, but you would get to decide what risk level to be in. Higher risk would just mean paying more.
That was me playing devil’s advocate, but I am Canadian, and I have a clue about the state of things in the US, so by default I am a fan of public health care. Still…I do wish people would take some responsibility for the risks they take, and that leads us back to government regulation. We can’t win!
…unless we trust, say, skateboarders’ desire not to break their heads as being enough of a deterrent from them doing the most dangerous stunts. For this specific case, at least, I’m OK with that.

So this is my opinion.. what i think about those helmet is that they can save your life from falling or something, but they make you look like if you were wearing a piece of crap in your head or like if someone just shitted on you! so i think they should make new helmets. new designs without rotten pussies and dicks..
